Terms of Service
1. Who we are
"Uplink Web Services" (we, us, our) is an Australian-owned business that provides web hosting, bespoke website development, and managed software products including Shopkit and (in development) Clubkit. Australian Business Number: (to be confirmed).
2. Service
We provide the services described on uplink.net.au at the prices listed there or quoted in writing to you. We endeavour to maintain 99.9% uptime for hosted services, monitored 24/7. Scheduled maintenance is announced in advance.
3. Payment
Hosting and SaaS subscriptions are billed monthly in advance via Stripe in Australian dollars (AUD), inclusive of GST. Bespoke development work is invoiced per project milestones. Subscriptions auto-renew until cancelled.
4. Cancellation + refunds
You may cancel a subscription at any time from the customer portal. Cancellation takes effect at the end of the current billing period. We do not prorate refunds on the unused portion of a month. Bespoke development work is non-refundable once that milestone is complete.
5. Acceptable use
Hosted content and email must comply with our Acceptable Use Policy. We reserve the right to suspend services that breach the AUP, with notice where practical.
6. Data + privacy
Your data is handled per our Privacy Policy. Our platform is open-source (AGPL); you may export a complete tarball of your hosted data + media at any time. We do not sell customer data.
7. Limitation of liability
To the extent permitted by Australian law, our liability for any loss arising from these services is limited to the fees you have paid in the 12 months preceding the event. Some statutory rights cannot be excluded under the Australian Consumer Law and Competition and Consumer Act 2010.
8. Governing law
These terms are governed by the law of New South Wales, Australia. Disputes proceed in NSW courts unless otherwise agreed.
